LAZ Statement on the Question of Whether Prisoners Should be Allowed to Vote

The Law Association of Zambia (LAZ) wishes to confirm the position taken by the Electoral Commission of Zambia that the provisions of section 19 of the Electoral Act are still in force and therefore prisoners, whether convicts or remandees are disqualified from voting. However, LAZ also notes that under the new Article 46 of the constitution, as amended in 2016, any citizen who has attained the age of 18 years is entitled to be registered as a voter and vote in an election by secret ballot. In other words, no one is disqualified from voting under the new constitutional provisions. This is a change from the old provisions of the pre-2016 constitution as contained in the former Article 75 of the Constitution that provided that the National Assembly could make laws providing for who may be disqualified from voting.
